Abstract |
The economic development of the state is currently largely dependent on the state of the credit and financial sector. Practice shows that criminal encroachments in this area are notable for their considerable diversity, highly intellectual character, and the ability of criminals to quickly adapt to new banking and information technologies. The current situation requires the development and implementation of adequate measures to ensure the stability of the credit and financial sector and its protection from illegal encroachments, including from unscrupulous borrowers. Considering these circumstances, the legislator provided for a number of compositions in the Criminal Code of the Russian Federation aimed at ensuring criminal legal protection of public relations related to the field of lending (Articles 159.1, 176 and 177 of the Criminal Code of the Russian Federation). The norms enshrined in them provide for the protection of the rights and interests of lenders from credit fraud, illegal obtaining of a loan and malicious evasion of paying off payables. At the same time, many questions remain related to the correct application of these standards. The study revealed the ambiguity of the approaches of scientists and law enforcement in resolving issues of determining legally significant concepts, objective and subjective signs of crime. The authors tried to consider the most significant debatable aspects of the objective signs of crime in the field of credit relations. |
